Terms and conditions

1. Who provides the service

Leadomos (leadomos.com) is a service of Guillermo Gómez Benavides, a self-employed professional trading as DETERMOS, with address at Avenida de Gibraltar 3, 28903 Getafe (Madrid), Spain. You can write to us at contactleadomos@gmail.com. The owner's other details are in the Legal notice. These terms govern the use of Leadomos and the purchase of its plans; by creating an account or subscribing, you accept them.

2. The service

Leadomos is a tool that finds public information about businesses, organises it and helps you prepare your outreach, including text written with artificial intelligence. The features available at any time are those shown on the website and in the application, and we may improve, change or withdraw them. The service is provided as is and as available: the data comes from third-party sources and may be incomplete, inaccurate or out of date.

3. Who may use it and your account

  • You must be over 18 and able to enter into contracts. If you subscribe for a company, you confirm you are authorised to bind it.
  • You must give truthful details and keep your password secret. The account is personal: you may not share it or create several to gain an advantage.
  • If you subscribe as a consumer (for purposes outside your trade or profession), you also have the rights the law gives you, set out in section 5.

4. Plans, prices, credits and payment

  • The plans, their prices (with any applicable taxes), the credits they include, their limits and any promotions are those shown on the pricing page and in the application when you subscribe.
  • Credits are internal units for using the service: they have no monetary value, cannot be exchanged for money or transferred, and may expire under the conditions stated when you get them.
  • To subscribe, you choose a plan, review and correct your details on our payment provider's checkout page before confirming, and receive a confirmation by email. The contract is made in English or Spanish; these terms remain published on the website.
  • Subscriptions renew automatically for equal periods until you cancel them in the application. Cancellation takes effect at the end of the paid period.
  • We may change prices or what each plan includes. We will give you reasonable notice before it applies to your subscription, and you may cancel before then at no cost.
  • If a payment fails, we may suspend the plan until it is settled.
  • If you subscribe as a business, payments are non-refundable unless the law provides otherwise.

5. Consumer rights

If you subscribe as a consumer:

  • Withdrawal: you may withdraw from the contract within 14 calendar days of subscribing, without giving a reason, using the «Withdraw from contract here» button in Billing or by sending a clear statement to contactleadomos@gmail.com (you may use the model below). As the service starts as soon as you pay, at your request, we will refund what you paid minus the proportion of the service already provided, within 14 days at the latest and by the same payment method.
  • Guarantee: the service is covered by the legal guarantee of conformity for digital content and services under consumer law.
  • Model withdrawal form (complete and return it only if you wish to withdraw from the contract): “To Guillermo Gómez Benavides (DETERMOS — Leadomos), Avenida de Gibraltar 3, 28903 Getafe (Madrid), Spain, contactleadomos@gmail.com: I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the supply of the following service (*): Leadomos subscription, plan […]. Ordered on (*): […]. Name of consumer(s): […]. Address of consumer(s): […]. Account email: […]. Signature (only if this form is notified on paper). Date. (*) Delete as appropriate.”

6. Using the service and your responsibility

Leadomos only gives you a tool. You decide whom you search for, what you do with the data and when and how you reach out, and you are solely responsible for doing so lawfully under the rules that apply to you, including data protection and marketing communication rules. You may not:

  • use the service for unlawful or fraudulent purposes or to infringe third-party rights;
  • send unsolicited marketing where the law forbids it, harass anyone or contact anyone who has objected;
  • process special categories of data or data about private individuals unrelated to their professional activity;
  • sell, publish or pass on the data obtained to third parties;
  • circumvent the service's limits, create several accounts to obtain credits or automate access;
  • damage, overload, copy or try to access the platform without permission.

If you breach this section, we may suspend or close your account and cooperate with the authorities.

7. Data processing

For the personal data Leadomos collects and stores on your behalf when you use the service (business contact details of people linked to the businesses you search for), you are the controller and Leadomos is the processor (GDPR Article 28). The processing has the subject matter, nature and purpose of the service you use, and lasts as long as you keep your account. Leadomos:

  • processes that data only on your instructions, which are your use of the service, unless the law requires otherwise, and will tell you if it considers an instruction infringes the law;
  • requires confidentiality from anyone with access to it and applies appropriate security measures;
  • may use other providers to run the service, under the same obligations, and will inform you of changes so you can object;
  • will help you, as far as it reasonably can, to respond to data subjects' rights and to meet your obligations on security, breach notification and impact assessments;
  • will notify you without undue delay of security breaches affecting that data;
  • will delete the data when you delete your searches or your account, unless the law requires it to be kept;
  • will make available the information needed to demonstrate compliance with these obligations and allow the audits required by law.

8. Intellectual property

Leadomos (software, design, text and brand) belongs to its owner. While you have an account, we grant you a personal, non-exclusive and non-transferable right to use it. Third-party public data belongs to its owners. You may use the text the service generates freely, at your own responsibility.

9. Suspension, cancellation and closure

  • We may suspend or close your account if you breach these terms, if an authority requires it, or if its use puts the service or third parties at risk.
  • You can close your account at any time from Settings; your data is then handled as described in the Privacy policy.
  • We may stop providing the service with reasonable notice. If you subscribed as a consumer, we will refund the proportion of what you paid for the period not enjoyed.

10. Liability

  • We do not guarantee the accuracy, completeness or currency of third-party data, the results you obtain, or that the service will run without interruptions or errors.
  • We are not liable for your use of the service, the data or the messages you send.
  • Indemnity: if a third party or an authority makes a claim against us over your use of the service or the data, you will take on our defence and any resulting penalties, compensation, costs and reasonable expenses.
  • If you subscribe as a business, we are not liable for loss of profit, business or data or for indirect damage, and our total liability is limited to what you paid us in the 3 months before the event giving rise to it.
  • These limitations apply to the extent permitted by law and do not exclude liability for wilful misconduct or gross negligence, or consumers' non-waivable rights.

11. Changes to these terms

We may change these terms. We will give you reasonable notice in the application or by email and ask you to accept the new version to keep using the service. If you do not agree, you can close your account. Changes do not affect periods already paid.

12. Governing law and complaints

These terms are governed by Spanish law. You can send complaints to contactleadomos@gmail.com and we will reply within the time the law sets. If you are a consumer, you may also turn to consumer bodies and the courts where you live. Otherwise, the parties submit to the courts of Madrid.

13. Other provisions

If any clause is void, the rest remains in force. Not exercising a right does not mean waiving it. If the service comes to be provided by a company owned by the owner, we will tell you. If language versions differ, the Spanish version prevails.
